Declaration of consent with regard to data protection and information on data processing

This data privacy statement applies to the processing of data by:

2. Collection and storage of personal data plus the nature and purpose of its use

If you place an order with us, we collect the following data:

    title, first name, last name,
    a valid email address,
    address,
    phone number (landline and/or mobile)

information necessary for the execution of any order you may have placed, in particular data required for the creation of a digital terrain model (current survey of the dredging lake, drawings of the machines/excavators, specifications on mining limits and slope inclination in accordance with planning approval, survey data, data on deposits and hydrographic data).

We collect this data

to be able to identify you as our customer;
to provide professional advice and to receive and process your order;
to communicate with you;
for invoicing purposes;
to process any liability claims you may have against us and to assert any claims against you.

The data is processed at your request and the processing is necessary according to Art. 6, Section 1 (1), Letter b of the GDPR for the purposes stated above for the processing of your order and for the mutual fulfilment of contractual obligations.

The personal data collected by us for the execution of the order will be stored until the end of the statutory retention period (6 years after the end of the calendar year in which the contract and/or the customer relationship was terminated) and deleted thereafter unless we are obliged to store the data for a longer period of time pursuant to Art. 6, Section 1 (1), Letter c of the GDPR due to retention and documentation requirements according to tax and commercial law (from the German Commercial Code (HGB), German Criminal Code (StGB) or Fiscal Code of Germany (AO)) or you have given your consent to the storage of your personal data for further use pursuant to Art. 6, Section 1 (1), Letter a of the GDPR.

3. Disclosure of data to third parties

Your personal data shall not be transferred to third parties for purposes other than those listed below.

We share your personal information with third parties only if this is necessary for the performance of a contract in accordance with Art. 6 Section 1 (1), Letter b of the GDPR. This includes in particular the disclosure of data to suppliers for the purpose of taking into account the technical data provided by you (current survey of the dredging lake, drawings of the machines/excavators, specifications on mining limits and slope inclination in accordance with planning approval, survey data, data on deposits and hydrographic data). The data disclosed shall be used by the third party only for the aforementioned purposes.

4. Rights of data subject

You have the right

in accordance with Art. 7, Section 3 of the GDPR, to revoke your previous consent to us at any time. This means that we are no longer allowed to continue processing the data based on this consent;

in accordance with Art. 15 of the GDPR, to request information about the personal data we process. In particular, you can request information about the purposes of the processing, the categories of personal data, the categories of recipient to whom your data has been or will be disclosed, the planned storage period, the right to rectification, erasure, restriction of processing or objection, the existence of the right to complain, the source of your data if not collected by us, and the existence of automated decision-making including profiling and, where appropriate, meaningful information about the details of same;

in accordance with Art. 16 of the GDPR, to demand the immediate rectification of inaccurate personal data stored with us or to demand its completion;

in accordance with Art. 17 of the GDPR, to demand the erasure of the personal data stored with us, unless processing is required for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;

in accordance with Art. 18 of the GDPR, to demand that the processing of your personal data is restricted if you contest the accuracy of the data, the processing is unlawful but you oppose its erasure and we no longer need the data while you, however, require the data to establish, exercise or defend legal claims, or you have objected to the processing in accordance with Art. 21 of the GDPR;

in accordance with Art. 20 of the GDPR, to receive the personal data you provided to us in a structured, commonly used and machine-readable format, or to request transmission to another controller;

in accordance with Art. 77 of the GDPR, to lodge a complaint with a supervisory authority. You can contact the supervisory authority of your usual place of residence, your place of work or our registered office.

5. Right to object

if your personal data is processed based on legitimate interests in accordance with Art. 6, Section 1 (1), Letter f of the GDPR, you have the right to file an objection against the processing of your personal data in accordance with Art. 21 of the GDPR, provided that there are reasons for this arising from your particular situation.
